Coal mine workers in West Virginia are faced with a multitude of hazards on every shift they work. Workers have the right to work environments that are safe and free of preventable hazards. A mine worker whose arm was amputated after a mining accident recently filed a civil lawsuit against the mining company for which he was working and also included three co-workers as co-defendants. The complaint states that the accident occurred in May of 2013 when the plaintiff became trapped between parts of a machine. The plaintiff claims that his right arm was crushed, causing damage that necessitated an amputation.
The plaintiff claims that the mining company exposed him to working conditions with known hazards and failed to comply with safety regulations. He contends that workers were not properly trained, and the mining company knowingly allowed three employees to work while they were intoxicated. It was noted that the mining company had been cited by the Mine Safety and Health Administration for its noncompliance with procedures.
In addition to compensation for medical expenses and lost wages, the plaintiff seeks punitive damages related to the amputation of his arm and the impact it has had on his life. He accuses the mining company of willfully violating labor codes and reckless disregard for workers’ safety. West Virginia workers who have suffered injuries in coal mine accidents may in some cases pursue personal injury compensation.
