Wrongful death: Collision in construction zone kills 1

Construction zones can cover miles and miles or roadway and cause significant delays in traffic at times. Companies must generally provide signs informing drivers of upcoming traffic delays to allow them ample time to adjust their speed accordingly. Should a driver fail to notice a slow in traffic, the results could be devastating. A recent rear-end collision that took place in a construction zone in West Virginia has reportedly led to the apparent wrongful death of a 38-year-old woman.

The accident reportedly took place on a recent Tuesday as several vehicles approached a nearby construction zone. While slowing down upon approaching this area, the woman’s vehicle was suddenly struck from behind by another car. After arriving at the scene, emergency responders advised they found her to be unresponsive and trapped within her vehicle, and she was pronounced dead at the scene soon thereafter.

The driver who caused the collision was taken to the hospital for treatment of injuries, and although a third vehicle was involved in the accident, the occupants reportedly remained unharmed. Authorities are continuing to investigate the incident, and although no further information was provided, they have advised that criminal charges could be pending. Should this person be deemed at fault in the accident, which is likely, the victim’s surviving family may choose to exercise their right to pursue restitution through civil court.

With the high costs of end-of-life expenses and a possible loss of income, those who lose a family member in a fatal accident may face substantial financial hardships. Since the civil justice system can be complex, those who wish to pursue restitution could benefit from seeking the counsel of a personal injury attorney early in the process. An attorney in West Virginia can assist a client in pursuing the restitution entitled through a wrongful death claim against the party deemed culpable.
