When drowsy driving causes motor vehicle accidents

Accidents happen for many reasons, and it can be hard to determine exactly what caused the incident. In some cases, drowsy driving may be to blame for motor vehicle accidents, causing as much damage and injury as an accident caused by drunk driving or speeding. When these accidents cause harm to innocent motorists, it is important to work with a lawyer who is experienced in complex injury claims.

As West Virginia readers know, drowsy driving occurs when a person gets behind the wheel of a car while sleepy or fatigued, perhaps even falling asleep behind the wheel. Statistics indicate that a small percentage of fatal accidents are related to fatigued driving, but those numbers increase for accidents that resulted in injury. While reckless or drunk driving receive a great amount of public attention as dangerous habits, drowsy driving is, unfortunately, rarely considered as a great danger to the public.

Drowsy drivers often display some of the same behaviors as drunk drivers. This includes swerving, driving at erratic speeds and even running red lights or stop signs. There is often a lack of firm evidence in drowsy driving accidents, but with help, it is possible to establish that a driver is liable for damages caused by his or her actions.

After an accident, it is important to reach out for help from an experienced legal team. If a victim is unsure of what caused the accident or unsure if liable parties should be financially accountable for damage, a case evaluation can be beneficial. Drowsy driving is a legitimate cause of motor vehicle accidents in West Virginia, and victims should take steps to protect their rights.
