What is Defective Construction?


Although courts have dealt with lawsuits alleging "defective construction" since their creation, recent trends show an increase in claims for these types of cases. One reason for this trend is the unprecedented growth and demand in the new housing market. Unfortunately, these booming markets have lured individuals motivated by profit and greed to obtain contractors licenses and begin building homes.


These builders typically have little experience in construction unlike the traditional artisans and tradesmen who have historically dominated this market. These builders are notorious for employing unskilled and overworked subcontractors. To add to this dangerous mix, building materials are becoming increasingly complex and require greater attention in selection and installation. At a time when construction site coordination has become more critical, many general contractors are inexperienced and unable to travel to multiple cosntruction sites which leads to increased delegation and reduced supervision. Fierce competition within the construction market places additional pressures on builders to cut corners. All the while, governmental inspection is decreasing because of lack of funding.
