New Class Action on Behalf of WV Fibernet Users

At approximately 5:30 a.m. on July 10, 2007, Fibernet experienced a network outage affecting its WV customers.

On July 12, 2007, a class action lawsuit was filed by Hill, Peterson, Carper, Bee & Deitzler, PLLC in the Circuit Court of Wood County on behalf of all West Virginia customers of Fibernet who lost service on July 10, 2007.

The Circuit Court of Wood County has now certified a class of all WV Fibernet customers. Fibernet has filed a motion to de-certify the class based upon changes to WV law and a ruling from the court is expected sometime this summer.
