Notes:

1. Verdict set aside and new trial awarded by the trial judge in August 2006, because the jury was exposed to potentially misleading evidence regarding Vioxx’s heart attack risk.

2. The jury returned a verdict in Cona’s favor on his NJ consumer fraud claim, finding Merck failed to adequately warn of cardiac risks, but not finding that Vioxx contributed to causing his heart attack.

3. Merck motion to overturn verdict, based on a claim of misconduct by a juror, is pending.
