Parkersburg Water Contaminated with C-8 from DuPont Emissions

Parkersburg (WV) residents may have a separate claim against DuPont due to rising levels of C8 contamination in their municipal water supply. The original Leach v. DuPont class action was filed as a lawsuit against DuPont for polluting the environment and drinking water with ammonium perfluorooctanoate also known as "PFOA," and also known as "C-8" in areas of West Virginia and Ohio near DuPont’s Washington Works plant. That settlement did not include claims arising from contamination of the Parkersburg municipal water supply. It only affected persons drinking water from the Lubeck and Mason County in West Virginia, and Belpre, Little Hocking, Pomeroy, and Tuppers Plains/Chester in Ohio.

At the time of the West Virginia/Ohio settlement in the Leach v. DuPont case, the C-8 levels in Parkersburg water, supplied by the Parkersburg Municipal Water Department, were below the class certification level of contamination (0.05 parts per billion). Residents of Parkersburg were not included in the Leach v. DuPont class action settlement (unless they otherwise fit the class action definition due to consumption of contaminated water from one of the other affected water sources).

In early 2006, the level of C-8 in the Parkersburg water rose above 0.05 ppb, and a separate lawsuit on behalf of residents of Parkersburg was filed against DuPont by the Leach v. DuPont team of lawyers. The case is presently pending in federal court. A motion has been filed seeking class action status. The Amended Complaint was filed May 26, 2006.

Among other remedies being sought, putative lead plaintiffs in the Parkersburg suit (William Rhodes, Russell Miller, and Valori Mace) are seeking clean water for Parkersburg residents, medical monitoring to ascertain if C-8 in the water has caused illness or disease, and monetary compensation for potential personal injury due to C-8 contaminated water being supplied to people in Parkersburg.
